UNIQUE PERMISSION / EU BLUE BOOK

After entering Romania you need to get a Unique License or the Blue Book of U.E. The document attests your right to stay in Romania and you can obtain it from the territorial units of the General Inspectorate for Immigration in the county where you live. To obtain the single EU Blue Card or EU Blue Card, you will personally submit a set of documents at least 30 days before the expiry of the visa right. You can also submit documents through the online application available at https://portaligi.mai.gov.ro/portaligi/

For the first prolongation of the right of residence (obtaining the first single permit or the EU Blue Card) for employment, you must submit the following documents:

- request;

- the border crossing document (passport, travel title, etc.) in original and copy;

- the proof of the legal possession of the living space in original and copy;

- labor contract;

- print screen from the general register of employees in the section where data about the individual labor contract, signed by the employer;

- salary enrolled;

- medical certificate

- taxes.

 

The single permit shall be renewed at least 30 days before the expiry date of the previous one. For subsequent prolongation of the right of residence (obtaining a new single permit) you must submit the following documents:

 

- request;

- the border crossing document (passport, travel title, etc.) in original and copy;

- the proof of the legal possession of the living space in original and copy;

- labor contract;

- salary enrolled;

- medical certificate

- taxes.

 

Other categories of foreign nationals who are prolonged their right of residence

 

1. DETAILED PARTIES:

 

a) request

b) the border crossing document (original and copy);

c) the translated and legalized posting decision;

d) proof of legal possession of the living space (original and copy);

e) evidence of means of subsistence at least at the level of gross average salary in the economy;

f) proof of social health insurance;

g) medical certificate;

h) taxes

 

2. FOREIGN PERSONS EMPLOYED BY A LEGAL PERSON WITH THE SEAT IN A MEMBER STATE OF U.E. OR SEE, DETAILED IN ROMANIA:

 

a) request

b) the border crossing document (original and copy);

c) translated and legalized posting decision;

d) a copy of the individual employment contract registered with the competent authorities of the respective Member State, translated and legalized;

e) a copy of the residence permit from the EU or EEA member state;

f) proof of the legal possession of the living space (original and copy);

g) proof of the means of maintenance at least at the level of the minimum gross salary in the economy;

h) proof of social health insurance;

i) medical certificate;

j) fees

 

3. HEADS OF REPRESENTATION

 

a) request;

b) operating authorization;

c) evidence of the legal relationship between the applicant and the representation;

d) proof of the legal holding of the registered office space;

e) evidence of means of maintenance;

f) medical certificate;

g) proof of the legal possession of the living space;

h) proof of social health insurance;

i) fees

 

4. SUCCESSAL / FILIAL LEADERSHIP

 

a) request;

b) the certifying certificate issued by O.NR.C .;

c) evidence of the legal relationship between the applicant and the representation;

d) proof of the legal holding of the registered office space;

e) medical certificate;

f) proof of the means of maintenance;

g) proof of the legal possession of the living space;

An application for granting or extending the right of residence for employment / posting will be settled within 30 days from the date of its submission. If further verification is required, the deadline for resolving the request may be extended by up to 15 days.

The application for an extension of the right of residence by the holder of the EU Blue Card obtained in another Member State shall be resolved within 15 days of receipt of the application.

Subsequent prolongation of the right of temporary stay for posting as an ICT worker shall be subject to the following conditions:

 

  • the recipient of the service has obtained a posting notice for the ICT worker concerned, under the special legislation on employment and detachment of foreigners on the territory of Romania;
  • provides proof of holding maintenance at least at the gross minimum earning.

 

The right of temporary stay for posting as an ICT worker is prolonged for the entire duration of the transfer within the same company but not more than 3 years for senior management and specialists and one year for trainee employees as of the date of entry into the territory Romania for this purpose.

Subsequent prolongation of the right of temporary stay for posting as an ICT worker is granted without exceeding a total of 3 years for senior management and specialists and one year for trainee employees as of the date of entry into Romania for this purpose, where the initial period of intra-corporate transfer was extended if the alien presented the following documents: a copy of the posting extension, translated and legalized, from which the duration of the intra-corporate transfer was extended; and the maintenance of the other posting conditions, the proof of holding the means of maintenance at least at the level of gross average earnings.

If the information or documents provided on which the application for an extension of the right of temporary residence for work purposes is based are inadequate, the General Inspectorate for Immigration shall inform the applicant of the additional information requested and shall set a reasonable time limit for sending them, but no longer more than 30 days. The initial 30-day application settlement deadline is suspended until the General Inspectorate for Immigration receives the necessary information or additional documents. If the additional information or documents have not been provided by the due date, the request may be rejected.

The right of temporary residence for work purposes is prolonged for a period equal to the period of validity of the employment contract, but not more than one year.

Foreigners, highly qualified workers, are given the right to stay temporarily for work purposes for a period equal to the period of validity of the employment contract plus 3 months but not more than 2 years.

Subsequent prolongation of the right to temporary residence for work purposes is also granted for the period during which the alien benefits from unemployment benefit.

Foreigners who have a right of residence on the territory of Romania for any of the purposes provided by O.U.G. 194/2002 on the regime of aliens in Romania, republished, with the subsequent amendments and completions, may request the extension of the right of residence for work purposes after obtaining a work permit without the obligation to obtain a long-stay visa for employment.
